Agreement to Our Legal Terms

We are Quran Academy and Youth Centre (QAYC) ('Organization', 'we', 'us', or 'our'), a registered New Zealand charity (Charities Services No. CC64722).

We operate the website https://qayc.co.nz (the 'Site'), as well as related products, educational programmes, youth mentorship initiatives, or services that refer or link to these Legal Terms (collectively, the 'Services').

These Legal Terms constitute a legally binding agreement between you and Quran Academy and Youth Centre concerning your access to and use of the Services. By accessing the Services or participating in QAYC programmes, you agree to be bound by these Legal Terms. If you do not agree with all of them, you must discontinue use immediately.

We may update these Legal Terms by changing the “Last updated” date. Please review them periodically. The Services are intended for users aged 13 and over. Users under 18 must have the permission of, and be directly supervised by, a parent or guardian. We recommend that you retain a copy for your records.

1. Our Services & Charitable Purpose

The information and Services provided on the Site advance QAYC's charitable objectives in Quranic education, Arabic language studies, youth mentorship, and community engagement in New Zealand. The Services are not intended for use where distribution would be contrary to law or regulation or create a registration requirement.

2. Intellectual Property Rights

Our Intellectual Property

We own or license the intellectual property in our Services, including source code, databases, functionality, software, designs, audio, video, text, curricula, educational materials, photographs, graphics, trademarks, service marks, and logos (collectively, the “Content” and “Marks”). They are protected by New Zealand and international law.

Your Use of Our Services

Subject to these Legal Terms, we grant you a non-exclusive, non-transferable, revocable licence to access the Services and download or print Content you have properly accessed, solely for personal, non-commercial educational use. Commercial copying, reproduction, distribution, sale, licensing, or exploitation requires our prior written permission. Requests should be sent to info@qayc.co.nz.

3. User Representations

By using the Services or registering for programmes, you represent that you have legal capacity, agree to these Terms, are not under 13, have parental permission if under 18, will not use automated access, will not use the Services illegally or without authorisation, and will comply with applicable New Zealand law.

4. Enrollment & Program Participation

Enrollment in classes, workshops, mentorship programmes, or events is subject to availability and acceptance by QAYC. Participants agree to respectful conduct and a safe, welcoming environment. Participants and guardians must provide accurate health, emergency contact, and accessibility information where requested.

For minors at events or overnight programmes, parents or legal guardians authorise QAYC staff and designated volunteers to seek emergency medical assistance if reasonable efforts to contact the primary emergency contact fail. QAYC may alter schedules, substitute instructors, modify delivery, or cancel events due to unforeseen circumstances, safety concerns, or insufficient enrollment.

5. Donations and Tax Receipts

QAYC accepts online donations to support its educational and youth initiatives. As a registered New Zealand charity (CC64722), eligible donations may qualify for donation tax credits. Receipts are issued electronically to the email provided. Donations are generally non-refundable; for an error or incorrect amount, contact info@qayc.co.nz within 14 days to request a refund review.

6. Prohibited Activities

You may not use the Services for purposes other than those for which they are provided. You must not systematically retrieve data; trick or defraud QAYC or users; bypass security; disparage or harm QAYC; harass, abuse, intimidate, or threaten others; violate law; frame or link without authorisation; upload disruptive material; use automated extraction tools; remove proprietary notices; impersonate others; or interfere with the Services or connected networks.

7. User Generated Contributions

The Services may allow comments, feedback, registrations, or other materials (“Contributions”). You represent that your Contributions do not infringe intellectual property or privacy rights, that you have required permissions and consents, and that they are not false, misleading, defamatory, obscene, objectionable, or unlawful.

8. Contribution Licence

You retain ownership of your Contributions and associated intellectual property. By submitting feedback, suggestions, or Contributions, you agree that we may use and share that feedback for non-profit purposes without compensation.

9. Third-Party Websites and Content

The Services may link to third-party websites or services, including payment gateways and donation platforms. We do not monitor or verify those websites and are not responsible for their content. A link does not imply QAYC endorsement.

10. Services Management

We may monitor the Services, take legal or administrative action for violations, restrict or disable access to Contributions or registrations, and otherwise manage the Services to protect our legal rights, charitable reputation, and functionality.

11. Privacy Policy

By using the Services, you agree to our Privacy Policy, which is incorporated into these Terms. The Services are hosted in New Zealand, and personal information is collected, stored, and processed in accordance with the Privacy Act 2020 (New Zealand).

12. Term and Termination

These Terms remain in force while you use the Services or participate in programmes. We may, at our discretion and without notice or liability, deny access to the Services or programme registration to any person for any reason.

13. Modifications and Interruptions

We may change, modify, or remove Services content at any time and without notice. We are not liable for any modification, suspension, or discontinuance of the Services.

14. Governing Law

These Terms are governed by New Zealand law. You and Quran Academy and Youth Centre irrevocably consent to the exclusive jurisdiction of the courts of New Zealand.

15. Dispute Resolution

Informal Negotiations

The parties agree to attempt informal negotiation for at least 30 days before formal proceedings. Negotiations begin when written notice is sent to info@qayc.co.nz.

Resolution Mechanisms

Claims within the New Zealand Disputes Tribunal jurisdiction, up to NZD $60,000, may be submitted to the Tribunal. Matters exceeding that jurisdiction will be submitted to private mediation or binding arbitration in Auckland under the Arbitration Act 1996, administered by an independent provider.

Services information may contain typographical errors, inaccuracies, or omissions, including course descriptions, schedules, and donation details. We may correct or update information at any time without notice.

19. Indemnification

You agree to defend, indemnify, and hold harmless QAYC and its trustees, officers, employees, agents, and volunteers from loss, damage, liability, claims, demands, and reasonable legal fees arising from your use of the Services, breach of these Terms, or violation of a third party's rights.

20. User Data

We maintain data you transmit to manage the Services and programme administration. While we regularly back up data, you remain solely responsible for the data you transmit.

21. Electronic Communications, Transactions, and Signatures

Visiting the Services, emailing us, and completing online forms constitute electronic communications. You consent to receive them and agree that electronic agreements, notices, disclosures, and receipts satisfy requirements that communications be in writing.

22. Miscellaneous

These Terms and policies or operating rules posted on the Services form the entire agreement between you and QAYC. Failure to enforce a right is not a waiver. If a provision is unlawful, void, or unenforceable, it is severable and does not affect the remaining provisions.
